Welcome to the Mia’s Home Staging website (the “Site”), operated by Mia’s Home Staging (“Mia’s Home Staging,” “we,” “us” or “our”) and located at https://miashome.co. Please read these terms of use (“Terms”) carefully before using the Site. By accessing, viewing, or using the content, material, products, or services available on or through the Site, you certify that you have read, understand, and agree to be legally bound by these Terms, as well as our Privacy and Cookie Notice. You further certify that you are 18 years of age or older (or at least the applicable age of majority in your state or territory of residence). You understand and agree that your use of the Site signifies that you fully accept and agree to these Terms. If you do not agree to these Terms, or if you are younger than 18 years of age, you are not granted permission to use the Site and must exit immediately.

THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND A CLASS ACTION WAIVER CLAUSE. BY USING THE SITE, YOU ARE ACCEPTING THIS AGREEMENT AND, WHILE YOU MAY STILL PURSUE CLAIMS AGAINST MIA’S HOME STAGING, YOU ARE AGREEING THAT YOU MUST PURSUE YOUR CLAIMS IN A BINDING ARBITRATION PROCEEDING (AND NOT IN A COURT) AND ONLY ON AN INDIVIDUAL (AND NOT A CLASS ACTION) BASIS. PLEASE READ THESE TERMS CAREFULLY TO UNDERSTAND YOUR RIGHTS AND RESPONSIBILITIES.

1. License to Use the Site
1.1. Subject to these Terms, Mia’s Home Staging hereby grants you a personal, limited, terminable, revocable, non-exclusive, nontransferable, nonsublicenseable license to access and use the Site solely for use in accordance with these Terms. You shall be responsible, at your sole expense, for procuring, operating, and maintaining the computer system, mobile device, hardware, software, and other items necessary or appropriate to enable you to exercise your rights and licenses hereunder. Without limiting any other provisions of these Terms, all software and other materials, including the Site, made available to you are the copyrighted work of Mia’s Home Staging or its licensors. Copying or distributing the Site or the Site Content (as defined below) is expressly prohibited.

2. Purpose and Content of the Site
2.1. All information and materials on the Site are presented solely for the purpose of providing general information on and promoting our products and services. Such information and materials do not constitute offers for our products and / or services, nor do they constitute advice or other instructions on the use of our products and / or services.

3. Registration
3.1. In order to access certain content, material, products or services on the Site, you may be asked to register and create an account. As part of the registration process, you may be asked to click to agree to these Terms or our service provider’s terms, and may then be asked to submit your email address and a password for your account. You may also be required to provide certain information about yourself including some types of personally identifiable information, including your legal name, phone number, birth date, address, and email address. You are responsible for ensuring that your password and account login are kept secret, safe, and secure at all times. Mia’s Home Staging will not be held responsible or liable for any misuse of your account in the event that a third party has access to and uses your password and account login in any way.
3.2. You represent that the personal information you provide via the Site is true, valid, complete and up-to-date in all respects. Should any of the information you provide on the Site change, please login to your account and update such information directly on the Site.

4. General Restrictions on Use
4.1. You agree to use the Site only for purposes that are permitted by these Terms and in compliance with all applicable laws, regulations, and generally accepted practices or guidelines in the relevant jurisdictions.
4.2. You will not (and will not attempt to): (a) access the Site by any means other than through the interfaces that are provided by Mia’s Home Staging; (b) gain unauthorized access to Mia’s Home Staging’s computer system or engage in any activity that interferes with the performance of, or impairs the functionality or security of the Site or Mia’s Home Staging’s networks and computer systems; (c) access the Site through any automated means or with any automated features or devices (including use of scripts or web crawlers, data mining, scraping, robots, spiders, or any other data gathering or extraction tools), except to the extent the Site is indexed by general purpose consumer-accessible search engines; (d) access or collect any personally identifiable information for any purpose, including commercial purposes; (e) reproduce, duplicate, copy, sell, trade, or resell any aspect of the Site for any purpose; (f) upload, post, or otherwise transmit, through the Site, any unsolicited or unauthorized advertising or other form of solicitation; (g) stalk, harass, or otherwise disturb another person; (h) impersonate another person; or (i) infringe any intellectual property rights of any person or entity.

5. Content on the Site
5.1. As between you and Mia’s Home Staging, Mia’s Home Staging owns or licenses all information and materials, including logos, designs, titles, phrases, product names, images, illustrations, icons, photographs, and the copyrights, trademarks, service marks, trade dress, and other intellectual property rights associated therewith, in or made available through the Site (“Site Content”), as well as the selection, coordination, arrangement, and organization and enhancement of the Site Content.
5.2. “Mia’s Home Staging” and other trademarks, logos, and service names displayed on the Site are subject to the trademark and other rights of Mia’s Home Staging. They may not be used without prior written permission.
5.3. Whenever you post information to the Site, that information may be accessible for other users. Choose carefully the information you post.
5.4. Mia’s Home Staging does not claim ownership in user-posted content (“User Content”), but by posting User Content, you grant Mia’s Home Staging a non-exclusive, sublicensable, transferable, irrevocable, fully paid-up, royalty-free, worldwide license to use it.
5.5. By posting User Content, you represent that you have the full legal right to provide such content and that it does not violate the rights of any person or entity, or any law.
5.6. You are solely responsible for the User Content you post. Mia’s Home Staging is not responsible for any User Content.
5.7. If posting a review, you represent it is truthful and based on your first-hand experience.
5.8. Mia’s Home Staging reserves the right to remove any information or materials posted for any reason or no reason.

6. Errors, Inaccuracies, and Omissions
Mia’s Home Staging endeavors to be accurate but does not guarantee that the Site or Site Content will be error-free.

7. Disclaimer
The Site and all materials are provided “as is” and “with all faults.” Mia’s Home Staging disclaims all warranties, express or implied.

8. Links To and Features Provided by Third Parties
The Site may link to third-party sites. Mia’s Home Staging is not responsible for such sites.

9. Service Access
Mia’s Home Staging does not guarantee the Site will be available at all times.

10. Limitation of Liability
Mia’s Home Staging, to the fullest extent permitted by law, shall not be liable for indirect, incidental, special, or consequential damages. If you are dissatisfied, your sole remedy is to discontinue using the Site.

12. Indemnification
You agree to indemnify Mia’s Home Staging and its affiliates for any claims arising from your use of the Site or breach of these Terms.

14. Dispute Resolution
Any dispute shall be resolved exclusively through final and binding arbitration in accordance with applicable laws, in San Francisco, California or another chosen location by Mia’s Home Staging.

These Terms and the use of the Site are governed by the laws of the State of California.

16. Miscellaneous
The Site is controlled and operated from within the United States. These Terms constitute the entire agreement between you and Mia’s Home Staging. If any provision is found invalid, the remaining provisions remain in effect.
